It has been have heard in trade that the custom officer asking for LMPC certificate from importer while allowing the clearance of shipment.
Attached herewith the LMPC act. And there are nowhere written that the shipment can not be allowed clearance if the importer doesn’t have lmpc.
however it allows the importer to get the certificate even within 90 days from the import. and he is not allowed to sale or distribute the goods unless he follows the LMPC rule.
if any manufacturer/packer/importer etc fails to follow the act if it’s required on their goods then the director or controller or any officer of LMPC department can penalize them for their fault.
The question is here if this rule is issued by another department and they have the duty to check and inspect then why the custom officers are denying the clearance of imported goods?
Kindly circulate this question to reach the concerned higher authorities and they must issue a valid public notice in this regard to avoid any confusion and delay in clearance of shipments .
