Hello users, if you check attached JNPT Customs Public Notice No 28/2023 dated 06.04.2023 regarding Clearance of import consignments where duty is not being reflected in ICES after payments.

It allowes some specific importers only any not for all importers, the Question is, are the other small and medium importers Money and loss does not matter to CBIC/ CUSTOM ?

Why they are exempted from this facility ? what are their fault ? do they have to bare the shipping companies and cfs detention even after payment has been debited from their account but not reflecting in icegate system against the bill of entry ?

We request to CBIC to extend this facility to all importers with the same or more tough condition as mentioned in P. Notice, Banks rules are same for all, either any AEO or normal importers .

it must be known that, if there are any royalty fees or license fees payable on imported goods by consignee to shipper. Then it must be mentioned in commercial invoice while importation of goods.

Because as per the custom manual and rule the custom duty is payable on such imported goods

Recently DRI has investigating similar case and issued show cause notice to the importer.

Commissioner of Customs Imports, Chennai II. raises a question that will there be refund allowed to importers, by customs ? who were charged and collected late filing by customs due to such purging of bill of entry problem in icegate system,

As per Hon’ble Madras High Court, the practice of purging of Bill of Entry appears to be based on the practice adopted in various ports on account of the architecture of the ICEGATE. There is however no provision either under the Customs Act, 1962 or under the provisions of Regulation which contemplates purging of the Bill of Entry.
